Alternative Dispute Resolution (ADR) refers to a means of resolving disputes between the parties that does not involve going to court, the most common ADR techniques are mediation, arbitration or conciliation.

MEDIATION

Mediation is where an independent and neutral third party helps you and the individual, entity or any other party that you are in a dispute with to reach a mutually acceptable outcome. The mediator simply adds formal structure to the communication between you and the other participant with the aim of helping you to reach a voluntary agreement.

Mediation offers the parties flexibility allowing you and the other participant to agree a settlement. Mediation is a completely confidential process; all parties and anybody else in attendance, will be required to agree to keep matters private.

A mediator will normally hold private conversations with each party, but the mediator will never disclose to the other party the content of those discussions, except where disclosure is permitted by that party.

SELECTING A VENUE

Mediation can take place at any mutually agreed location. It is important to ensure that the venue is neutral and reasonably equipped to hold the mediation.

We can assist the parties by arranging appropriate conference facilities at a range of venues across England and Wales. The cost of the venue will be divided equally between the parties.

OUR MEDIATORS

Mediators are not subject to statutory regulation like some other professions. The Civil Mediation Council (CMC) runs a system of voluntary regulation for civil or commercial and workplace mediators.

JPLH Consulting prides itself on appointing professional mediators who are registered with the CMC and will provide you with an assured dispute resolution service. Our professional mediators have been trained to acceptable industry standards, abide by the CMC Code of Conduct, hold professional indemnity insurance, carry out ongoing professional development and offer access to a complaints process, if required.
